Terms of Service

Welcome to Just a Girl Studio (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website at justagirlstudio.comand our creator tools, including Promptly (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.
Just a Girl Studio is a sole proprietorship operated by Janine Swearingin and based in the State of Florida, United States. Where these Terms refer to a business entity, that entity is the sole proprietorship unless and until we form a corporate entity, in which case we will update this Section.
1. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you confirm that you are of legal age and that the information you provide is accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2. Description of Service
Promptly is an AI-powered tool that lets you analyze reference images, generate new images, and turn images into short silent video clips. The Service uses third-party AI models (including Anthropic, Google, and OpenAI). Output may vary, may not match your input precisely, and may occasionally fail; this is normal for generative AI.
3. Acceptable Use
These restrictions are enforced both by these Terms and by automated content filters built into the Service. Attempting to circumvent the filters (via misspellings, leetspeak, or character substitution) is itself a violation.
You agree NOT to use the Service to:
- Generate content depicting any minor (anyone under 18) — clothed, unclothed, real, or stylized — in any context. Reference images must depict adults only.
- Generate nude, partially nude, sexually suggestive, or sexually explicit content of any kind, regardless of subject age.
- Generate content depicting violence, gore, blood, injury, death, or physical harm to any person.
- Generate content depicting weapons (firearms, knives, explosives, or other tools designed to harm) — whether held, brandished, displayed, or implied.
- Impersonate real people without their consent, including deepfakes used for harassment, fraud, or defamation
- Create content intended to deceive or mislead in commercial, political, or news contexts
- Violate any law or third-party intellectual property rights
- Reverse engineer, scrape, or attempt to extract our prompts, model weights, or system internals
- Resell or redistribute access to the Service without prior written permission
We may suspend or terminate your account for violation of this section without refund.
4. Content Ownership
Your inputs: You retain ownership of any reference images you upload. You grant us a limited license to process them through our pipeline (which involves passing them to third-party AI models for analysis and generation).
Your outputs: Subject to applicable third-party model terms (Google, OpenAI, Anthropic), you own the images and videos generated through the Service and may use them for personal or commercial purposes. You are solely responsible for how you use generated content.
Our platform: The Service itself, including the software, design, brand, and prompt engineering, is owned by us and protected by copyright and trademark law.
5. Credits and Purchases
Some features of the Service consume credits. Credits are non-transferable, have no cash value, and may not be sold or exchanged. Free credits are granted on a periodic basis (currently monthly) and may be changed at our discretion. Paid credits are granted upon successful payment and remain in your account until used. Refunds are governed by our Refund Policy.
We may change pricing at any time. Existing paid credits remain valid at the rate they were purchased.
6. Third-Party Services
The Service relies on third-party providers (Anthropic, Google, OpenAI, Stripe, Resend, Supabase, Vercel). Their availability, pricing, and terms are outside our control. We are not liable for outages, delays, or content moderation decisions originating from third-party providers.
7. Termination
You may stop using the Service at any time. We may suspend or terminate your account for violation of these Terms, suspected fraud, or extended inactivity. Upon termination, your access to credits and previously generated content stored on the Service may be lost. We recommend downloading any output you wish to retain.
8. Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will meet your expectations.
9. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via email or in-app notice. Continued use of the Service after the effective date of an update constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.
